MPORTANT INFORMATION ABOUT SUPPLY TEACHERS DURING THE STRIKE(S)
With the upcoming strike(s) and recent queries from our schools, we have decided to provide information on what is, and what is not legally allowed to be covered during a strike.
Due to Regulation 7 of the Conduct of Employment Agencies and Employment Business Regulations 2003, a teaching supply agency is unable to provide cover for Teachers whom are on strike. The only cover that an agency can provide for is for a Teacher who is on leave or training (including sick), as long as they would not be on strike if they were not on leave.
The above is important to take into consideration as it would be deemed as inappropriate for an agency to provide cover for any Teacher that is, or would be on strike if they were not on leave or training. We have therefore made the decision to provide cover on the 30th June for Teachers whom are genuinely off, and would not be on strike if they were not due to be off.
Any supply staff member being supplied must not perform any duties normally performed by a worker taking part in industrial action or any other worker who is assigned by the client to cover the duties of another taking part in industrial action.
For clarity, this also means that a Supply Teacher currently being provided to a school to cover a Teacher on long term sick or maternity for example, can not provide cover for the strike period IF the worker being covered would be on strike if they were not already absent from work.
